Calvary Hill Baptist Church, owner, and Pastor John Ribbins, appeal to construct a parking lot on an approximate 47’ x 88’ lot situated in a B1 Two-Family District on the west side of East 103rd Street at 2170 East 103rd Street; subject to the limitations of Section 337.03, the parking lot is not permitted in a Residence District and Section 349.13(c) provides that when in its opinion the best interest of the community will be served, the Board of Zoning Appeals may permit parking on land in a Residence District, if it abuts or is across the street from a district other than a Residence District; and contrary to Sections 352.09 and 352.10, a 10’ wide transition strip is required on both sides and at the rear of the proposed parking lot and none is provided where the land abuts a Two-Family District; and a 3’ wide transition strip is proposed instead of the 6’ that is required between the parking lot and the street along East 103rd Street; with a 6’ high chain link fence proposed, where 4’ is the maximum height allowed and an ornamental fence that is 50% open is required for a front yard in a Residence District, as stated in Section 358.04 of the Codified Ordinances.
